Response from Minister Paradis to email about C-11

On the 21st September, I emailed the minister about C-11. I asked specifically why the government was making it illegal to bypass the region encoding to watch the DVDs I purchased in Europe here in Canada. Here's the response I received today.

Dear Mr. Brand:

Thank you for your email regarding copyright reform. I regret the delay in replying to you.

Recognizing the critical role a modern copyright regime plays in Canada’s digital economy, the Government of Canada is delivering on its commitment to introduce and seek swift passage of copyright legislation that balances the needs of creators and users.

On September 29, 2011, the government introduced Bill C-11, the Copyright Modernization Act. This legislation reproduces the provisions of Bill C-32, which appeared in the last session of Parliament. It will promote Canada’s innovation and creativity, and ensure that our copyright laws are modern, flexible and in line with current international standards. It proposes a fair, balanced and common sense approach that respects both the rights of creators and the interests of consumers in today’s market. Through this bill, the federal government seeks to promote Canada’s participation in the digital economy, a major element in ensuring the continued prosperity and competitiveness of our country.

Bill C-11 includes provisions that prohibit the circumvention of digital locks and the manufacture, importation, and distribution of products or services that permit their circumvention. These provisions recognize that certain digital lock protections are important tools for copyright owners to protect their digital works and are often a significant part of online and digital business models.

The Bill also includes a number of specific instances where circumventing digital locks is permitted. In addition, the Government of Canada will retain the ability, through regulatory power, to provide new exceptions to the digital lock prohibition in order to ensure access where the public interest might be served or where anti-competitive behaviour arises.
