CIPPIC replies: Mississauga--Brampton South Green Party candidate

Received from Paul Simas:

Music File-sharing:

;:Ans: Not illegal, but regulated.

Technological Protection of Copyrighted Materials:

;:Ans: My position is that regulation is the key. Copyrighted material can be protected but the public should have the right to produce back-ups for personal enjoyment.

Educational Use of Internet Materials: Do you support an amendment to the Copyright Act to allow for the use of freely available materials on the Internet by participants in an educational program?

;:Ans: Yes.

ISP Liability for copyright infringement:

;:Ans: Regulation. The role of ISP's is not to be an Internet police. Liability should reside with webmasters who post copyrighted materials. Legislation could require index.htm pages to include verifiable contact details on any canadian webmaster. When transmitting files, An ISP could add a disclaimer. "the ISP assumes no responsibility for files transmitted over the Internet. Any copyright infringement and/or consequences rests with the transmitter"

What is your position on the Standing Committee on Canadian Heritage's proposed "notice and takedown" scheme requiring ISPs to remove content on the sole basis of alleged copyright infringement?

;:Ans: ISP's cannot be Internet police. The responsibility and/or consequences of posting copyrighted materials needs to rest with the webmaster.

Open Source Software:

;:Ans: I need more info.

;:Ans: Good question. I wish I had a very good answer, but I think that a great majority of Spam mail originates all over the globe. Spam is similar to phone marketters. We cannot restrict our access to information.

National ID cards:

;:Ans: I don't think that ID cards should be viewed as "passports", but as a national equivalent of a Birth Certificate. Many countries have it. Today most people use their Driver's licence as ID. The National ID would remove the "ID" responsibility from Driver's Licence, and provinces.
