Bad cases, bad caselaw, and the lack of technical knowledge of courts.

A Out-Law.com article includes:

A court in Dallas, Texas has found a website operator liable for copyright infringement because his site linked to an 'audio webcast' without permission. Observers have criticised the judge for failing to understand the internet.

I think this case demonstrates the need for "friends of the court" briefs to be included in technology law cases, as well as the problems with having defendants representing themself without the assistance of a lawyer. The website host, Robert Davis, likely didn't foresee the possibility that the judge would have so little experience with the Internet.

I hope and expect this bad judgement to be appealed, with other deep-linking and Internet-related cases being reviewed. Hopefully this will also include the hiring of a qualified lawyer.
