Assuming for the moment that this story is true (and that this kind of
device is still in use), surely those devices would be illegal to operate 
anyway ? I can't imagine that after tracking down the offending devices
they said "Ah, that explains it." and went home, leaving them
broadcasting.

It's pretty clear to me that this is one of those "look at the harm
caused, we must pass a law" when causing that kind of harm is
already clearly covered by the law.
