Also, as far as I can tell, it's wrong. http://laws.justice.gc.ca/en/P-4/86684.html#rid-86851 The Patent Act, section 42 says (in part) "grant to the patentee ... the exclusive right, privilege and liberty of making, constructing and using the invention and selling it to others to be used" - so if you hold a patent on something, nobody else can legally build duplicates without permission, regardless of what they intend to do (or not do) with them.
